Zachry Michelle A. Allan, Esq. Michelle Allan is an Associate currently practicing in the firm's Workers' Compensation Section. Ms. Allan obtained her Bachelor of Arts in English from Indiana University of Pennsylvania, and she obtained a Bachelor of Arts in Philosophy from the University of Pittsburgh. She obtained her Juris Doctor from the University of Pittsburgh School of Law, where she received the Judge David Shahl Memorial Scholarship. In addition to practicing Workers' Compensation Law, Ms. Allan focuses her practice on addressing Medicare issues in workers' compensation settlements through the preparation of Medicare Set-Aside arrangements. This includes preparing Medicare Set-Aside Arrangements and having the same approved by the Centers for Medicare and Medicaid Services to ensure that Medicare's interests have been adequately considered as required by the Medicare Secondary Payer Statute. Ms. Allan is an international commissioner for the Medicare Set-Aside Allocation Certification Program, organized through the CHCC. Prior to attending law school, Ms. Allan worked as a journalist, reporting daily news for the Pittsburgh Tribune-Review. While attending law school, Ms. Allan served as an extern for the United States Magistrate Judge Ila Jeanne Sensenich in the United States District Court for the Western District of Pennsylvania. Ms. Allan is admitted to the Pennsylvania Supreme Court and the United States District Court for the Western District of Pennsylvania. She is a member of the American Bar Association, the Pennsylvania Bar Association, and the Allegheny County Bar Association. Pamela J. Anderson-Mahoney, Ph.D. Dr. Mahoney is the founder and director of Epidemiology Resources. More and more, the courts require peer-reviewed published reports to confirm causality. Epidemiology Resources' mission is to respond to this requirement by providing evidence-based assessment of causation in occupational and environmental matters. This may come in the form of scientifically structured review of articles submitted by opposing counsel's experts, literature-based deposition questions, full literature review, or a new study design, implementation and interpretation. Dr. Mahoney's professional experience spans both the private and public sectors. She has worked for state and local health departments, federal government agencies, the aerospace industry, health maintenance organizations, universities, and she has been a principal investigator on research projects both privately and publicly funded. Educated at UCLA, she has had the advantage of training at one of the premier schools of public health with special emphasis on epidemiologic methods. Dr. Mahoney's post-doctoral work was completed at the National Institutes for Occupational Safety and Health as a fellow in the Centers for Disease Control and Prevention's Epidemic Intelligence Service (EIS) - often referred to as the "disease detectives." Steven J. Appleby Steven J. Appleby is a State of California, licensed Private Investigator specializing in Worker's Compensation Subrosa Investigations. Steven is President and CEO of Appleby & Co., Inc., headquartered in Fresno, California. Appleby & Co., Inc has been operating throughout California since 1958, offering legal support, investigative, imaging , workflow and video production services. Appleby & Co., Inc. has branch offices in Bakersfield, Sacramento, and Santa Ana. Steve earned his Bachelors Degree in Communications from the University of the Pacific in Stockton, California. He is past President of the Central California Adjusters Association and a former member of the Fresno Industrial Claims Association as well as Professionals in Workers' Compensation, Valley Industrial Claims Association, and the Association of Workers' Comp Professionals. He is also a member in good standing of the California Association of Licensed Investigators (CALI) and California Association of Legal Support Professionals. Christine Baker Christine Baker is the Executive Officer of the Commission on Health and Safety and Workers' Compensation (CHSWC) in San Francisco since its inception in 1994. She has served in several management capacities in the California Department of Industrial Relations (DIR) since 1984, including Chief of the Division of Labor Statistics and Research and Deputy Director for the Division of Workers' Compensation. Previously, Ms. Baker worked at various research organizations and taught college courses on US military bases in Japan and Korea and at the Confucian and Catholic Universities in Seoul, Korea. Under her leadership, CHSWC has grown into its role of overseeing the health, safety and workers' compensation systems in California and recommending administrative and legislative changes for improvement. CHSWC from the start has based its recommendations on findings from studies conducted by independent researchers, with the involvement of the entire community. Ms. Baker currently is a member of the executive committee of the International Association of Accident Boards and Commissions (IAIABC), a member of the advisory board for John Burton's Workers' Compensation Policy and Review. She is also a member of the steering committee for the Workers' Compensation Research Group. She is also a member of the National Academy of Social Insurance. Ms. Baker earned a Masters Degree and achieved Ph.D. candidacy at the School of Education, University of California, Berkeley. Donald R. Barthel, Esq. Donald Barthel was born in Anchorage, Alaska. He graduated from University of Michigan, Ann Arbor, with honors in 1986. He received his Juris Doctorate from U.C.L.A. in 1990, and immediately thereafter he was admitted to the State Bar of California. Mr. Barthel's entire legal career has been dedicated to the defense of employers' rights in the arenas of labor law, employment law, and workers' compensation. During the last dozen years, his practice has exclusively focused on workers' compensation defense and related matters. With many years' experience in southern and northern California, he has appeared at virtually every WCAB district office in the state. Mr. Barthel is an acknowledged expert regarding the American Medical Association Guides to the Evaluation of Permanent Impairment. He has taught adjusters, human resource directors, employer representatives, attorneys and physicians throughout California and the United States. Because of his expertise, Mr. Barthel recently has been invited to be a reviewer for the 6th edition of the AMA Guides. Melvin Belsky, MD Melvin Belsky, MD, is a graduate of the Medical College of Wisconsin, with training in Internal Medicine and Physiatry. Dr. Belsky has practiced in California since 1979 and has extensive experience in all aspects of Rehabilitation Medicine, in multiple settings, across the spectrum of care. Dr. Belsky assumed the Medical Directorship for Corporate Workers' Compensation at Safeway Inc. in 2004. He subsequently assisted in the development of the Safeway Select MPN and PBN, and continues as the Medical Director of the MPN. He has created early intervention Program for injured workers at risk for "delayed recovery," and is a founding member and first Chair of the California Consortium for the Promotion of SAW/RTW. Susan R. Borg, Esq. Sue Borg is a 1985 alumna of the University of San Francisco School of Law. She has been a managing partner in DuRard, McKenna and Borg of San Mateo since 1995. From 1992 through 1995, Sue served on the State Bar Executive Committee on Workers' Compensation. She has been active on the Board of Governors of CAAA since 1995 Co-Chairing Consumer Information Services, Division of Industrial Relations and Seminar committees. In 1996 Sue founded CAAA's San Francisco Chapter and served as it's first president until 1999. She was awarded CAAA's San Francisco Chapter Attorney of the Year Award in 2005. As a writer, Sue has been published many times in numerous periodicals. Throughout her career, she has spoken on many workers' compensation issues to both professional groups and lay people. Ms. Borg is currently the president of the California Applicant's' Attorneys Association. Rosie Cerna Rosie Cerna is the Regional Safety Specialist for Whole Foods Market's Northern California Region. Ms. Cerna has been in her current position for five years and a total of 13 years with Whole Foods. She holds a Bachelor of Science degree from the University of San Francisco in Organizational Behavior. Presently there are 26 locations in Northern California, spanning from Fresno, Sacramento, Sonoma, Napa, North and South Bay and the Peninsula with a Team Member base of over 5,000. Her Region has been chosen to head a working partnership with FIT to integrate FIT's Bionomic principles into the Wholes Food's safety culture. Ms. Cerna has lead the way in creating an environment where Team Members willingly engage in safety measures when seeing the personal benefits these programs provide. Dennis Downing Dennis Downing is CEO and Founder of Future Industrial Technologies (F.I.T.), an international organization with the goal of reducing workers' compensation costs through effective injury prevention protocols. For over 11 years he has worked with companies large and small across America. Dominic Dugo, Esq. Dominic Dugo is a career prosecutor with the San Diego County District Attorney's Office. After prosecuting traditional criminal cases for 6 years, Mr. Dugo has spent the last 16 years working in the Insurance Fraud Division. Mr. Dugo has prosecuted and/or supervised the handling of workers' compensation, auto insurance, healthcare/disability, and life insurance fraud cases. Mr. Dugo established San Diego's Premium Fraud (1996) and Medical and Legal Insurance Fraud (2005) Task Forces. Both of those were the first of their kind. In 1999, Mr. Dugo was named Insurance Fraud Prosecutor of the Year by IASIU for Southern California. Mr. Dugo has served as Assistant Chief and Chief of San Diego's Insurance Fraud Division. In 2007, Mr. Dugo accepted the position of Director of Fraud Grants. Mr. Dugo, a premium fraud expert, has authored several articles on this topic and frequently teaches how to investigate and prosecute these cases. Mr. Dugo obtained a B.A. in Political Science with highest honors and a JD in law with honors (top 5%) from DePaul University in Chicago, Illinois. John C. Duncan John C. Duncan, for the second time in his career, has been appointed Director of the California Department of Industrial Relations (DIR). Duncan has had a distinguished career in both state and federal service including an appointment as special assistant to former U.S. Secretary of Defense, Caspar Weinberger. He assisted the Secretary in writing "Fighting for Peace," an autobiographical account of the Secretary's years at the Pentagon. In 1987, he received the Secretary of Defense Award for Outstanding Public Service. His current state government appointment-by Governor Arnold Schwarzenegger on August 9, 2007-follows previous service to DIR that included chief deputy director and then DIR director from 1995 to 1999. From 1991, he was DIR deputy director of communications. During his first DIR tenure, he was the principal advisor to Governor Pete Wilson on labor and employment issues and was a member of his Cabinet. As DIR Director, Duncan oversees a department with 2,700 employees and a $382 million budget. He also serves as the administrator of apprenticeship and as an ex-officio member of the State Compensation Insurance Fund Board of Directors. Duncan has also had significant private sector experience in labor and regulatory matters. He was president of Duncan Consulting, Inc. where he designed communications strategy for corporate, legal and governmental clients and specialized in navigating labor-related regulatory issues. He was also president and COO of Magnitude Information Systems, a company specializing in software and internet solutions for preventing workplace injuries, for several years. As part of his federal service, Duncan was an assistant to the secretary at the U.S. Department of Defense and special assistant to the deputy assistant secretary of defense for International Security Affairs, East Asia and Pacific Affairs. He is a graduate of the University of California, Berkeley, with a bachelor's degree in history and of Harvard University's John F. Kennedy School of Government with a master's in public administration. Duncan is a board member of the Yosemite National Institute and California Conservation Corps Foundation, a former president of the Industrial Relations Association of Northern California, and a former chair of the California Employment Training Panel. Mary E. Farrell, Esq. Mary E. Farrell is a partner with the Labor and Employment Law Team of Murphy Austin Adams Schoenfeld LLP. She has extensive experience representing both pubic and private employers in all aspects of employer-employee relations including wrongful termination cases, employment discrimination and harassment matters, privacy issues, proprietary rights/trade secret conflicts, wage and hour laws, personnel policies, reduction-in-force, and employee leave issues. In addition to her employment law practice, Mary handles complex business litigation cases and intellectual property matters. As an effective advocate, she successfully resolves many disputes short of trial by way of dispositive motions and/or settlement negotiations. Scott G. Hauge Scott G. Hauge is the President and owner of CAL Insurance & Associates, Inc., located at 2311 Taraval Street, San Francisco. The company was founded in 1927 and currently has 31 employees. The agency specializes in providing insurance for small to medium sized businesses. Mr. Hauge has been a leading advocate in paving the way for small and medium sized businesses. He has introduced government legislation that has affected business on local, state and national levels. He is considered one of the insurance industry's leaders in setting guidelines and has received numerous awards and countless commendations for his efforts. He is the founder of the San Francisco Small Business Advocates and most recently, Small Business California. Theodore C. Hanf, J.D., M.P.H. Ted C. Hanf is a principal with the Southern California law firm of Kegel, Tobin & Truce, a workers' compensation defense firm representing employers and insurors in workers' compensation and related matters. He has been a practicing attorney since 1975 and is AV rated and is certified as a workers' compensation specialist by the State Bar of California Board of Legal Specialization. In addition to his law degree, Ted has a Masters in Public Health from Johns Hopkins, and has participated in conferences with the Centers for Disease Control and Prevention and the American Public Health Association as well as employer, risk management, human resources, and attorney organizations. William A. Henderson Bill Henderson has spent over 33 years working for public agencies in the risk management field. He has been the risk manager for the City of Livermore for the past 13 years. As such, he has represented Livermore on the Board of Directors on the California Joint Powers Risk Management Authority, CJPRMA, holding the position of President from 2000 - 2006, and the Local Agency Workers' Compensation Excess Joint Powers Authority, or LAWCX, where he currently holds the position of Treasurer. Prior to coming to Bay Area, Bill was Risk Manager for the City of Port Angeles, Washington. Lori C. Kammerer Lori C. Kammerer is recognized nationally as a leading authority on policy issues affecting California's Workers' Compensation System. Lori has represented the business community as Executive Director of the California Coalition on Workers' Compensation from 1987-2002. More recently, she founded Kammerer & Company and serves as the Legislative and Workers' Compensation Policy Director for employers and trade associations across the state. Victoria L. Katchis, Esq. Victoria Katchis is managing attorney for the Liberty Mutual staff legal office in Sacramento, which specializes in general liability, workers' compensation, auto, products and construction litigation. She joined Liberty Mutual 1996 and became the managing attorney in 1998. Prior to Liberty Mutual, Victoria practiced workers' compensation defense with Laughlin, Falbo, Levy and Moresi. Before law school, Victoria was a Stockbroker with M.L. Stern & Co. in Beverly Hills, specializing in municipal bonds and second trust deeds. Barry Lesch, Esq. Barry Lesch graduated from Boalt Hall School of Law in 1975, started practicing state workers' compensation law the following year and has been doing so ever since. He is a senior partner at Laughlin, Falbo, Levy and Moresi, working out of its Oakland office. Mr. Lesch is a certified specialist and a managing editor of the California Workers' Compensation Reporter, a well-regarded journal reporting on significant California decisions in workers' compensation and workers' damages for 35 years. He collaborated on the evidence chapter in the CEB book, California Workers' Compensation Practice (fourth ed.), several editions of the CEB guide to statutory deadlines in workers' compensation law and innumerable talks on current case law and significant issues in compensation law. Amy E. Lopes Amy joined the Save Mart team in 1989. The past eight years of her career have been spent within the Risk Management Department as a Field Supervisor. All of Amy's experience paid off when in October of 2007, Amy was promoted to Manager of Workers' Compensation and General Liability. As a manager, she oversees a workers' compensation program for over 22,000 employees. Amy's duties entail, integrating risk and safety information from a multitude of sources, and translating that data into action. In addition, Amy has daily interaction with Save Mart's Third-Party Administrator in order to mitigate claim costs. A vital part of Save Mart's cost-containment program is the Save Mart MPN Network. By working with the MPN Coordinator, she provides guidance in provider selection and other aspects of the MPN network operation of behalf of Save Mart Supermarkets. Amanda A. Manukian, Esq. Amanda A. Manukian has been with the Law Office of Floyd, Skeren & Kelly, LLP since 2003. She is currently the Managing Attorney of the Pasadena Office and the Managing Attorney of the Special Investigations Unit (SIU). She also served as the Fraud Liaison with State Compensation in 2002 and part of 2003. Suzanne Marria, Esq. Suzanne Marria is an attorney who has practiced in the areas of workers' compensation and occupational safety and health law since 1986. From June 1999 to January 2004, Ms. Marria served as the Undersecretary/Assistant Director and Acting Chief Deputy Director of the California Department of Industrial Relations, which is now part of the Labor and Workforce Development Agency. She served as a key advisor in the negotiations that led to reform workers' compensation bills including AB 749, SB 228 and AB 227. She also worked as a staff attorney in the CalOSHA Legal Unit, for the WCAB reconsideration unit, in the Office of the Director, Legal Unit, for the Industrial Medical Council and as a Workers' Compensation Administrative Law Judge. Currently as a staff attorney with the Division of Workers' Compensation she works with and advises the Medical Unit on matters relating to utilization review and the qualified medical evaluator system. Ms. Marria is a graduate of UC San Diego (B.A., cum laude 1975) and Golden Gate University School of Law (J.D., 1983). Donald C. Marshall, CFE, AHFI, FCLS Donald C. Marshall is Vice President and National Director of the Anti-Fraud Program for Zenith Insurance Company. A police officer for 12 years, Don worked as a patrolman and, later, became a Detective assigned to the White Collar Crime Unit. Due to an injury, in 1988 Don retired and worked as a Private Investigator specializing in insurance fraud investigations before going to work for Citibank as a credit card investigator. He later worked for Progressive Insurance as a field Fraud Investigator; California Casualty Insurance as Corporate SIU, Zenith Insurance Company as Manager of Investigations and was Vice President of Investigations for CalFarm Property and Casualty and Health prior to its purchase by Nationwide Insurance. There, he assisted in the development of an internal anti-fraud program for their third-party administrator program. Don has also been qualified and has testified as an expert witness in insurance fraud in both Municipal and Superior court. Don has received his Certified Fraud Examiner and Fraud Claim Law Specialist designations, is a former member of the Executive Board of the National Healthcare Anti-Fraud Association and of the Board of Directors of NHCAA's Institute for Health Care Fraud Prevention of Washington, DC. Most recently, he has been awarded the Accredited Health Care Fraud Investigator designation by NHCAA. He has his BS degree in Criminal Justice Administration from California State University, East Bay and is a Licensed Private Investigator. Duane Matsunaga Duane Matsunaga has been associated with the insurance claims industry since 1979, a career that spanned 27 years. He began his career with Liberty Mutual as a multi-line claims adjuster handling workers' compensation, general, and auto liability claims. Mr. Matsunaga has 22 years' experience as a claims manager for such companies as Argonaut, Transamerica, TIG Insurance Company, and Cambridge Integrated Services Group, Inc. He graduated from California State University (Fresno) and has his Self-Insured Certificate from the State of California. Currently, Duane is the Director of Marketing for Bradford & Barthel, LLP. In that capacity, he assists with marketing efforts, client presentations, claims education, and internal audits. Michael G. McDonald, Esq. Michael G. McDonald is the founder of McDonald Law Corporation in Concord, California. Mr. McDonald graduated from Marquette University in Milwaukee, Wisconsin. He received his law degree from California Western School of Law in San Diego, California. Mr. McDonald has over 20 years of California workers' compensation law experience, is a Judge Pro Tem for the Workers' Compensation Appeals Board, and is a certified specialist in Workers' Compensation by the California Board of Legal Specialization of the State Bar of California. Sean McNally, Esq. Sean McNally is the vice president of human resources and legal counsel for Grimmway Farms in Bakersfield, California. He is certified by the State Bar of California as a specialist in workers' compensation law. He is a licensed general contractor and serves as a trustee for the Self Insurer's Security Fund. His community activities include serving on the Kern Adult Literacy Council Board of Directors as the president, and as a member of the Board of Directors of the Golden Empire Gleaners and the Board of Trustees for Garces Memorial High School. He graduated from the University of San Francisco with bachelor's degrees in English and Theology. Following that, he did graduate studies at Hebrew University in Jerusalem Israel. Robert M. Milane Robert M. Milane is the Managing Director of Risk Management for FedEx Ground Inc., the small-package ground delivery unit of FedEx Corporation. His duties include the direct responsibility for FedEx Ground, Fed Ex Home Delivery, FedEx Supply Chain Services and FedEx SmartPost's Property and Casualty Insured and Self-Insurance programs, including the administration of the claims functions associated with these exposures. Mr. Milane is a graduate of the University of Akron School of Law and has been involved in Risk Management for the past 27 years. Joseph M. Miller Joseph M. Miller was appointed Chairman of the California Workers' Compensation Appeals Board by Governor Arnold Schwarzenegger in June 2005. Born and raised in Los Angeles, he practiced law in California for over 30 years before his appointment and was a partner of Seyfarth Shaw, a national management labor and employment law firm. Before he began representing employers and insurance carriers, Chairman Miller represented employees and labor unions for a number of years. He graduated with honors from Harvard University, received his law degree from the University of California at Berkeley, and completed an LL.M. degree in administrative and labor law at New York University. Chairman Miller served as Chair of the State Bar Workers' Compensation Law Advisory Commission and was a member of the State Bar Board of Legal Specialization. He has a strong background in mediation, personal injury law, and employment law, with particular emphasis on medically-related problems, workers' compensation, and disability issues. The author of several law review and law journal articles, Chairman Miller has conducted frequent seminars on workers' compensation and related issues throughout the country. He is also a co-author of the treatise, California Workers' Compensation Practice, published by the Continuing Education of the Bar. Philip Millhollon Phil is CSIA's Executive Director, taking over that position in November of 2005. Prior to this current position, Phil worked for Chevron Corporation for 36 years. He worked in Chevron's Workers' Compensation Division since 1981 and was the Claim Manager from 1989 through 2005 with overall responsibility for Chevron's Workers' Compensation activity in 25 state and federal jurisdictions. Prior to joining CSIA, Phil served on the following committees: California Manufacturers and Technology Association - Chair of the Workers' Compensation Committee 1998 to 1995; California Self-Insurers Association - Board of Directors 2001 to 2005, and Chairman of the Board 2004 to 2005; California Self-Insurers Security Fund - Trustee, 2002 to 2006; National Council of Self-Insurers - Board of Managers 2005; and Workers' Compensation Research Institute - Research Committee Member, 2002 to 2005. Phil has a BA from San Francisco State University. He is also a certified Self-Insurance Administrator and he has his CPDM. Frank Neuhauser Frank Neuhauser is on the research faculty at the University of California at Berkeley's Survey Research Center. There his work has focused on disability insurance and other social insurance programs, judicial processes, and medical delivery. Since receiving his Masters in Public Policy from the Goldman School of Public Policy in 1993, worker on long-term forecasting models for state revenue and expenditures. More recently Mr. Neuhauser has worked extensively on workers' compensation, occupational injuries, and the cost of occupational medical treatment. His models and analyses were extensively used in legislative and policy debates during the recent of reforms to the workers' compensation system. Carrie Nevans Carrie Nevans was appointed to the position of Deputy Administrative Director (AD) for the California Division of Workers' Compensation in February 2006 and is also serving as Acting Administrative Director. Ms. Nevans brings a wealth of workers' compensation experience to her role. She started her career as a claims adjuster for the State Compensation Insurance Fund in 1982. She is a certified self-insurance administrator and is fully versed in all the specifics of workers' compensation, as well as the ethics of claims administration. As AD, Ms. Nevans administers the division's diverse programs and manages a staff of 1,200, along with a budget of over $135 million. Ms. Nevans has overseen the promulgation of regulations for medical treatment guidelines, return-to-work provisions, predesignation of personal physician and others. This year Ms. Nevans is specifically focused on promptness and quality of care for injured workers as well as improving access to the division's services for non-English-speaking workers. Ms. Nevans received her Bachelor of Arts degree in political science in 1979 and, prior to her current appointment, gained administrative and fiscal expertise working for the Department of Corrections (CDC), the Department of Finance, the California State Senate and the Department of Industrial Relations. Daniel P. O'Brien, Esq. Dan O'Brien is currently the Managing Attorney of the Law Offices of Floyd, Skeren & Kelly's Fresno office location. He is a member of the California Bar, the American Bar Association and the Fresno County Bar Association. He has been a Certified Specialist in Workers' Compensation Law as Certified by the Sate Bar of California and is an AV Rated Attorney by Martin-Dale-Hubbell Peer Review. He has argued and tried cases representing insurance carriers, self-insured employers and public agencies of all types before the Workers' Compensation Appeals Board (WCAB), the California Appellate Courts and the California Supreme Court. Mr. O'Brien has served as an instructor for the Insurance Education Association (IEA) and has been a frequent speaker on workers' compensation at local meetings and state conventions. Mr. O'Brien has more than 30 years of experience in workers' compensation defense and has served as a Pro-Tempore Judge before the WCAB. He is a graduate of San Diego State University and Southwestern University School of Law. He as been listed in Who's Who in California and Who's Who in American Law and currently serves on the Board of Directors of the California Workers' Compensation Defense Attorneys Association. He has been active in many charitable, community and fraternal organizations and served as a Naval Flight Officer in Viet Nam where he was awarded an Air Medal with three Gold Stars. Kristi O'Connor Kristi O'Connor began her career as a legal assistant and then office manager of a personal injury law firm. She later began her career in claims with a major workers' compensation insurer. She held increasingly responsible positions with that company, from claims assistant to claims management. Her responsibilities involved supervising a claims staff and out of state adjusters, ensuring proper handling of the claims. Kristi brings her years of claims experience to Owen-Dunn Insurance Services as a Workers' Compensation Specialist providing claims management services to our valued clients. In this role, she offers guidance to many companies, assisting human resources in all aspects of workers' compensation. Barry S. Pearlman, Esq. Barry Pearlman founded the Law Offices of Pearlman, Borska & Wax in 1984. He specializes in subrogation, the defense of workers' compensation claims, labor law, serious and willful misconduct claims, and claimed violations of Labor Code §132a. He is an experienced litigator and has successfully tried various and complex issues before the Superior Court, the Workers' Compensation Appeals Board, and Appellate Courts. Mr. Pearlman represents employers, insurance carriers, and third-party administrators. Mr. Pearlman works closely with a number of Special Investigation Units of various companies in connection with defending fraudulent claims, both through the employer and the insurance carrier, as well as in seeking reimbursement and restitution. He graduated from the University of California at Los Angeles in 1978 where he obtained a bachelor of science degree in political science. He obtained his Juris Doctorate degree in 1981 from Southwestern University School of Law in Los Angeles, California. Mr. Pearlman has taught courses in workers' compensation and insurance. He also has presented seminars to many insurance companies, self-insured administrators, and self-insured employers in connection with the handling of workers' compensation matters, fraud cases, RICO claims and claims involving the Americans with Disabilities Act. He also handles civil claims, including subrogation and claims of bad faith handling. Mr. Pearlman is an appointed arbitrator for the State Bar of California and is a member of the State Bar of California, the United States District Court for the Central District of California, the American Bar Association, the Los Angeles County Bar Association Attorney-Client Relations Program, the California Workers' Compensation Defense Attorneys Association, the Defense Research Institute, the Workers' Compensation Community Task Force, and the Administrative Director's Advisory Committee on Permanent Disability and Medical Provider Networks. He is immediate past President of the California Workers' Compensation Defense Attorneys' Association and past President of the Southern California Workers' Compensation Defense Attorneys' Association. Bernyce Peplowski, MD Dr. Peplowski is the National Medical Director and Executive VP of Zenith Insurance. She has been practicing occupational medicine for 26 years, and started her career as an on site occ med physician at Lockheed. Prior to joining Zenith Insurance, she was the Director of Occ Med at Southern California Permanente Medical Group. Dr. Peplowski has been a QME, and has been a committee member for the ACOEM Treatment Guidelines since their inception. She currently is a member of the DWC Treatment Guides Committee. She has served as an Instructor for UCLA since the 1980s. Dr. Peplowski, and the Zenith, are focusing on the development of a hand selected provider network. The selection process and maintenance of the network are grounded in the principles of partnership, highest quality medical care, return to function, collaboration in lieu of utilization review and accountability. The accountability is structured around a metric system coupled with chart review. The metric system becomes a feedback loop for both the provider and the Zenith. Jeffrey W. Pettegrew Jeffrey W. Pettegrew of Lafayette, California, serves as Executive Director, of the California Self Insurers' Security Fund (SISF), and was appointed to this new position in January, 2004. He manages an internal staff of three employees as well as a team of twelve service providers who all provide support to the Security Fund. SISF is a non-profit, mutual benefit corporation chartered by the State of California in 1984 to provide continuation of workers' compensation benefits to all injured workers of the state's private self-insured employers in the event any self-insured companies default on their workers' compensation obligations. The Security Fund manages over $6 billion in aggregate collateral obligations and financial guarantees in order to assure continuing payment of future workers' compensation benefits to impacted workers. Mr. Pettegrew previously served as Vice President of Risk Management & Insurance for Westaff, an international staffing company headquartered in Walnut Creek, CA, for 13 years. Prior to that, he was Chief Administrative Officer/Risk Manager of the Contra Costa Municipal Risk Management Insurance Authority, a pioneering self-insured joint powers authority of 18 cities, for 10 years. He also served as the City of Sunnyvale's first Risk Manager. Mr. Pettegrew was named "Risk Manager of the Year" in 1989 by Business Insurance magazine and served nine years as Chairman of the BI national Workers Compensation Conference. He also served as President of the Public Agency Risk Managers Association (PARMA); the California Joint Powers Association (CAJPA); and the Golden Gate Chapter of the Risk and Insurance Management Society (RIMS). James P. Pettibone, Esq. James P. Pettibone started his career with Workers' Compensation Defense firm Parrish & Moriarity as a Paralegal and Law Clerk from 1981 through 1985. Neil R. Piethe Neil Piethe is the Claim Manager for Foster Farms which is self insured and self administered for workers' compensation, liability and property claims. He is a graduate of the University of California, Santa Cruz and has over 25 years claims experience in the insurance industry. Previously with Industrial Indemnity and Fremont Compensation with experience as a claim supervisor, claim manager and home office legal director, his expertise includes workers' compensation, civil litigation, coverage and subrogation. Rick Plein Rick is Bureau Chief of the Workers' Compensation Program for the Fraud Division, California Department of Insurance. Prior to promoting to the Bureau Chief position in June 2005, Rick was the Chief Investigator of the Enforcement Branch's Headquarters Office and later the Fraud Division's Sacramento Regional Office. Rick has been with the Fraud Division since 1992 working assignments in both the Los Angeles and Sacramento areas. During his tenure with the Fraud Division he has worked a variety of workers' compensation fraud investigations, on both the state and federal levels, including claimant fraud and medical-legal mills. Rick has a Bachelor of Arts Degree in Criminal Justice from CSU Fullerton. Steve Poizner Steve Poizner was elected California Insurance Commissioner on November 7, 2006 and took the Oath of Office on January 8, 2007. Commissioner Poizner has been described as "independent" (Modesto Bee), "a man of integrity" (LA Times) and someone with "an impressive command of the issues" (SD Union Tribune). A highly successful businessman/entrepreneur, Poizner founded several companies, the most recent of which pioneered life-saving technology that put GPS receivers into cell phones. As a result, 9-1-1 emergency responders are able to locate with pinpoint accuracy those making emergency calls from cell phones. This technology is now the industry standard and can be found in more than 200 million cell phones around the world. While the Insurance Commissioner post is his first elective office, Poizner has long been active in public service and civic affairs. In 2001-02, Poizner served as a White House Fellow in Washington, D.C., where he was the Director of Critical Infrastructure Protection in the National Security Council. He is also a co-founder of EdVoice and has served on the boards of several organizations committed to assisting disadvantaged children in K-12 schools. Poizner also spent a year teaching 12th grade government at Mount Pleasant High School in East San Jose. As Insurance Commissioner, Poizner oversees the California Department of Insurance (CDI), the largest consumer protection agency in the state. CDI has more than 1,300 employees, a $200 million budget and regulates more than one-seventh of the California economy. Poizner was born and raised in Houston, Texas. He did his undergraduate work at the University of Texas where, based on academics and extracurricular leadership, he was named the Top Male Student in the University. Poizner was also recognized as one of the Top 10 Electrical Engineering Students. He moved to California in 1978 to attend Stanford University, where he earned a Master's Degree with Honors in Business Administration. Anne Searcy, MD Dr. Anne Searcy was appointed to the position of executive medical director for the California Division of Workers' Compensation (DWC) in March 2006. Searcy manages all the division's medical and health-related programs, including the qualified medical evaluator, medical provider network, independent medical review, utilization review, health care organization and spinal surgery second opinion programs. She also guides the provision of optimal medical services in the workers' compensation system by educating and training primary treating physicians, identifying research needs and overseeing studies related to workers' compensation medical services and analyzing and implementing new legislation and policies in conjunction with the DWC administrative director. Ms. Searcy is a licensed physician and surgeon and is board certified in family practice. She received her Bachelor of Arts degree in biology from U.C. San Diego and attended medical school at U.C. Davis. Ms. Searcy completed an occupational and environmental medicine "mini residency" at U.C. San Francisco and completed post-graduate courses in occupational medicine at the Medical School of Wisconsin. Ms. Searcy worked as both a physician and medical director in occupational medicine practices before coming to the Department of Industrial Relations, where she has served as associate medical director at the Industrial Medical Council and for the DWC since 1995. John Shin Mr. Shin started with Farmers Insurance in 1993 and has worked with several other insurance companies and third-party administrators specializing in workers' compensation. Mr. Shin started with ValleyCrest in 2004 and is currently the Risk Manager for ValleyCrest Companies. His responsibilities include oversight of all claims to include, workers' compensation, construction defect, general liability and auto property damages. Mr. Shin earned his B.S. in Criminal Justice Administration from San Diego State University, San Diego. Mr. Shin is a member of the Risk & Insurance Management Society. Daniel R. Sovocool, Esq. Mr. Sovocool is a seasoned partner with nearly twenty years of experience. A primary focus of his practice is advising national clients on a variety of insurance (and self-insurance), regulatory and business matters, particularly in the area of workers' compensation. He serves as Legal Counsel to the California Self-Insurers' Security Fund, to which all employers in the State of California who self-insure their workers' compensation liabilities must belong, and regularly counsels the Fund on matters of bankruptcy, insolvency, litigation and claims administration. He speaks regularly on self-insurance matters to various trade and business organizations. Stewart, ARM-P, CPCU Mary Stewart is the Director of Research and Development for the Public Entity Risk Institute (PERI). She is responsible for PERI's E-Training and the Data Exchange Program, which is a web-based data warehouse created to offer performance measurement and benchmarking tools for public entities. PERI offers research, training, and educational activities for nonprofit, governmental, and small business organizations. Prior to joining PERI Ms. Stewart was the Wrap-Up Manager for Aon Risk Services in Washington, DC, and a Client Relationship Manager for Aon's Government & Institutions Sector providing "Best in Class" insurance products and services to non-profit and public sector clients. She was a licensed Property & Casualty Insurance Broker in Virginia, Maryland, District of Columbia, Connecticut, Pennsylvania, and Ohio. Her past experience includes 25 years as a risk manager for three different public entity risk management programs located in the Commonwealth of Virginia; two of which were created from scratch under her direction. She has been recognized nationally as an expert in public sector risk management. Mary was on Business Insurance's Risk Manager of the Year, Honor Roll in 1991, received an Award of Merit, from ITT Hartford Insurance in 1996, and PRIMA's Risk Manager of the Year in 2001. Ms. Stewart has a Master of Safety Science Management from the University of Southern California and a General Certification in Law Enforcement from the Northern Virginia Criminal Justice Academy. Toby Stime Toby Stime joined The Simon Companies in 2001 with a background in health insurance benefits, plan design and contract negotiation. In addition to having created California's first approved Medical Provider Network, Toby is responsible for the growth and maintenance of The Status PPO Network, an established Medical Provider Network featuring over two-thousand California medical providers spanning more than fifty specialties. In addition, Toby manages relationships with our Network Partners, and participates in case rate and special service negotiations. Tracy Sturtevant, Esq. Tracy Sturtevant, a UCL:A law graduate and partner with Gray & Prouty represented injured workers for two years before moving to the defense firm of Allen, Rhodes & Sobelsohn in 1986. In 1997, she opened the Santa Barbara office of Gray & Prouty, moving to the San Francisco Bay area office in 2004. For over 20 years, Tracy has protected the interests of carriers, self-insured employers and adjusting agencies on all issues before the WCAB. An attorney whose secret wish is to be a teacher, Tracy believes that education and communication are vital to assist employers in controlling comp costs. Nadia Tarlow Nadia is a project manager in customer support for Remedy Interactive, where she provides product support, strategic guidance, implementation assistance and training for customers. Nadia also served as a project manager for Omega Performance, a global company that provides training and consulting for financial services professionals. Additionally, she was as a project director for Pacific Data Corp., a market research company; conducted qualitative and quantitative research for large corporations including Dial, Shaklee and Colgate Palmolive. Nadia has a B.S. in Psychology from Dominican College in San Rafael, CA and an M.A. in Psychology from The San Francisco School of Psychology. Lachlan Taylor Lachlan Taylor is a Workers' Compensation Judge serving on the staff of the Commission on Health and Safety and Workers' Compensation (CHSWC) since January 1, 2004. Prior to working with the Commission, Judge Taylor served as a trial judge since 1995 at the Sacramento and later at the Oakland offices of the Workers' Compensation Appeals Board. Previously he was a Senior Staff Counsel at the State Compensation Insurance Fund and in a private workers' compensation practice he represented employers, insurers and public agencies. Mr. Taylor began practicing law representing injured workers in 1975. Charles L. Thompson, IV, Esq. Charles L. Thompson, IV is a partner in Kauff McClain & McGuire LLP in California. He has extensive litigation and trial experience representing employers in wrongful termination, discrimination, and other employment-related cases. Mr. Thompson primarily counsels employers in all areas of employment law. This includes employee discipline and termination, ADA compliance in the workplace, and the Family Medical Leave Act. Mark works closely with workers' compensation regulators, policymakers, and advocates in the business community and organized labor to maintain the efficient operation of California's multi-billion dollar worker benefit system. He also provides current and prospective policyholders with the latest news on workers' compensation issues. Previously, Mark was Assistant General Counsel for American International Companies (AIG) for four years, where he coordinated all lobbying activity on legislative and regulatory issues involving property and casualty, life and annuity, and consumer finance lines of business. Mark also served as Vice President, State Affairs, for the American Insurance Association (AIA), where he led the advocacy and analysis of legislative and regulatory activities affecting the property and casualty insurance industry throughout the Western United States. In addition to being a member of the Arizona State Bar, Mark has been a lobbyist for insurance organizations and also a Deputy Director of the Arizona Department of Insurance. Mark serves on numerous advisory and legal committees for the California Division of Workers' Compensation, CWCI, CHSWC, WCRI, and the several state business associations. Mark holds a BA Degree in Political Science from the University of Arizona and a JD Degree from the University of Arizona, College of Law. Steven Wiesner, MD Steven Wiesner, M.D. is a physiatrist and Chief of the Occupational Health Department and Co?chief of the Physical Medicine and Rehabilitation Department with the Kaiser Permanente Medical Center in Oakland, California. He serves as the Medical Director for the Kaiser Permanente Medical Care Program, California Workers' Compensation Department-Northern California and is the National Physician Advisor for Kaiser Permanente's Integrated Disability Management Program. Dr. Wiesner received his undergraduate and medical training at the University of Wisconsin-Madison and completed his internship and residency training in Physical Medicine and Rehabilitation at the Northwestern University Medical School/Rehabilitation Institute of Chicago. Following completion of his residency, Dr. Wiesner continued at Northwestern University, as a faculty member, as well as developing two outpatient musculoskeletal clinics. Dr. Wiesner joined The Permanente Medical Group in 1994 where he provides clinical care to injured and ill workers as well as services requested directly by employers, including preemployment evaluations, medical surveillance, fitness-for-duty assessments and work site evaluations. Dr. Wiesner has a special interest in disability management and is a member of the American Academy of Physical Medicine and Rehabilitation, the American College of Occupational and Environmental Medicine and the California Medical Association. Alex Wong, Esq. Alexander Wong is a graduate of the University of California, San Diego, and University of California at Berkeley Boalt Hall School of Law. He is a certified specialist in workers' compensation law. After working as a workers' compensation defense attorney for the San Francisco City Attorney's Office, he went into private practice as an applicant's attorney and now is a partner at Jones, Clifford, Johnson and Johnson. In 2001, he served as the chair of the Executive Committee of the Workers' Compensation Section of the State Bar of California. He currently is an author of the St. Clair treatise: California Workers' Compensation Law and Practice. He is the former chair of the San Francisco Democratic Party, and a former Regent of the University of California. Larry Wong, CIH Larry Wong is the Safety Manager for the University of California system. His responsibilities include overseeing the environmental health and safety program for University of California Office of the President and acting as a liaison to coordinate UC systemwide environmental health and safety issues. Previously Larry was the EH&S Program Manager at UCSF where he was the UCSF Chemical Safety Officer and managed the Department Safety Office Program. Larry was the Northern California Section Chief for the California Department of Toxic Substance Control for 14 years where he oversaw the several hazardous waste management programs such as the creation of the Certified Unified Program Agencies, the household hazardous waste program, the small site clean-up program, and the tiered permitting program. Larry was an industrial hygienist with Cal/OSHA for over 10 years where he worked as a field compliance officer, conducted health and safety research in the Special Studies Unit, and also developed the Cal/OSHA asbestos regulations. Larry is a Certified Industrial Hygienist and has been an instructor with the University of California Davis Extension program since 1989. Larry is a past member of the American Standards for Testing and Materials (ASTM) and was the primary author of the ASTM standard, "Training Outline for Household Hazardous Waste Collection Operations." He is a member of the American Industrial Hygiene Association (AIHA) and is the past Chair of the AIHA Environmental Issues Committee. Larry graduated from the University of California Berkeley with a degree in zoology. William M. Zachry Mr. Zachry has held the position of Vice President, Corporate Workers' Compensation with Safeway Inc. since 2001. Prior to joining Safeway, he held positions as Senior Vice President, Chief Operations Officer for eStellarNet (2000-1001), Vice President, Zenith Insurance Company (1998-2000), Senior Vice President, C.E. Heath Insurance/HeathCal/CareAmerica Comp/HIH Insurance (1987-1998), Claims Manager/Settlement Specialist, Western Employer Insurance (1985-1987) and Supervisor, Workers' Compensation, Self-Insurance Program (1983-1985). He obtained his BS in Business Administration, Personnel & Industrial Relations, Wage & Salary Administration at the San Francisco State University. He has completed Financial Management program at Stanford University, Process Mapping and Operational Analysis at Pepperdine University, and Risk Management Concepts at Marsh. Mr. Zachry's professional appointments include State of California Fraud Assessment Commission, Self-Insurance Security Fund, California Grocers Association, California Chamber of Commerce, California Retailers Association and California Applicants' Attorneys Association.
